Included Product definition
Included Product means any pharmaceutical or biological composition containing the Compound, including the product currently trademarked in the United States as AndexXa™. For clarity, references in this B▇▇▇ of Sale to “an” Included Product or to “the” Included Product refer to any Included Product.
Included Product means, as of the Funding Date, Optune, NovoTAL and the Novo TTF-100L System, and, thereafter, any future product, including any current Preclinical Products (a) commercialized by Borrower or its Subsidiaries which are owned or controlled by Borrower or its Subsidiaries or (b) out-licensed by Borrower or its Subsidiaries.
Included Product means Tebi and each Back-up Product. For clarity, references in this Agreement to “an” Included Product or to “the” Included Product(s) refer to any Included Product(s).

Without limiting the foregoing, the Purchaser Agent and each Purchasers acknowledges and agrees that the Purchaser Agent, each Purchaser and their respective Affiliates, together with their representatives, have made their own investigation of each Included Product and are not relying on any implied warranties or upon any representation or warranty whatsoever as to the future amount or potential amount of the Revenue Interests or as to the creditworthiness of the Company.

Included Product means (a) any BA Product and (c) any Follow-On/Cannibalizing Product.
