Improved Product definition

Improved Product means any non-genetically modified autologous fibroblast product in the Field that is created, produced, identified, or modified in whole or in part by or on behalf of Fibrocell during the Term using Intrexon Channel Technology, Intrexon IP, or the Intrexon Materials under the Fibroblast Program to improve the formulation or production process of the Existing Product.
Improved Product means any product that (a) is a new version, model and/or other improvement of, and (b) has the same basic functionality as, an existing HD Product, Water Purification Product and/or IC Product set forth on Exhibit 1 as of the Effective Date.
Improved Product means any and all new developments or versions of the Licensed Product delivered to Licensee under this Agreement.

Examples of Improved Product in a sentence

  • From time to time during the Term, Intrexon shall have the right to obtain from Fibrocell samples of Fibrocell Product or Improved Product sold by Fibrocell or its Affiliates or sublicensees, or other items which reflect public uses of the Intrexon Trademarks or patent markings, for the purpose of inspecting the quality of such Fibrocell Products or Improved Products, the use of the Intrexon Trademarks, or the accuracy of the patent markings.

  • Fibrocell covenants that it shall not use any trademark confusingly similar to any Intrexon Trademarks in connection with any products (including any Fibrocell Product or Improved Product).

More Definitions of Improved Product

Improved Product means any product that consists of (a) the Lung Sealant Formulation or the Dural Sealant Formulation and a Focal Delivery System or an Ethicon Delivery System, or (b) an Improved Formulation and Delivery System 1, the VATS Delivery System, a Focal Delivery System or an Ethicon Delivery System.
Improved Product means any and all new developments or versions of the Product made by Licensor, including, but not be limited to, new therapeutic indications for Normothermic Use, and developments intended to enhance the safety and efficacy of the Product in Normothermic Use.
Improved Product shall have the meaning set forth in Section 17.6.
Improved Product means a variant (including, without limitation, all upgrades and downgrades) of a Product, which variant (a) is not in existence as of the date of this Agreement, and (b) has at least fifty percent (50%) of the total number of its Components in common with the Product upon which such variant is based; Improved Products shall become Products and shall be governed as such under the terms and conditions of this Agreement only as provided in Section 4.9 hereof.

Improved Product means any and all modifications, improvements, additions, alterations, or refinements to a Product, whether patented or unpatented, (i) that relate solely to the detection of antibodies to HIV-1 or HIV-2, (ii) are subject to a Regulatory Approval that permits the Product, as so modified or improved, to be marketed and sold in the Segments in the Territory and (iii) that OraSure has the right to market in the Territory; provided that a New Product shall not constitute an Improved Product.
