Impaired Class definition

Impaired Class means an impaired Class within the meaning of section 1124 of the Bankruptcy Code.
Impaired Class means a Class of Claims or Interests that is Impaired.
Impaired Class means a Class that is impaired within the meaning of section 1124 of the Bankruptcy Code.

Examples of Impaired Class in a sentence

Section 1129(a)(10) of the Bankruptcy Code shall be satisfied for purposes of Confirmation by acceptance of the Plan by an Impaired Class of Claims.

The Debtors request confirmation of this Plan under section 1129(b) of the Bankruptcy Code with respect to any Impaired Class that does not accept this Plan pursuant to section 1126 of the Bankruptcy Code.

Pursuant to section 1126(c) of the Bankruptcy Code and except as otherwise provided in section 1126(e) of the Bankruptcy Code, an Impaired Class of Claims has accepted this Plan if the Holders of at least two-thirds (2/3) in dollar amount and more than one-half (1/2) in number of the Allowed Claims in such Class actually voting have voted to accept this Plan.

Section 1129(a)(10) of the Bankruptcy Code shall be satisfied for purposes of Confirmation by acceptance of the Plan by at least one Impaired Class of Claims.

If any Impaired Class rejects the Plan, the Debtors reserve the right to seek to confirm the Plan utilizing the “cramdown” provision of section 1129(b) of the Bankruptcy Code.


More Definitions of Impaired Class

Impaired Class means each of Classes 2, 5, 6 and 7 as set forth in Article III of the Plan.
