Impacted Area means fiscal impacts to local governments within Meagher County, which includes Meagher County, City of White Sulphur Springs and School District #8 White Sulphur Springs K-12. Job opportunities and economic benefits will extend to Broadwater, Cascade, Gallatin, Judith Basin, Lewis & Clark, Park and Wheatland Counties. Additional economic benefits will extend further depending on where goods and services for the Black Butte Copper Project are purchased.

Impacted Area means a geographic area, where a road or bridge project is being undertaken including those being conducted in phases by the Connecticut Department of Transportation and adversely affects the economy of that area as determined by the Commissioner of Economic Development in consultation with the Commissioner of Transportation.

• The Parties agree to consider pursuing the development of a new comprehensive MOU, or multiple individual agreements, with the other entities providing the full range of public services within the Impacted Area as part of ongoing discussions contemplated to communicate and coordinate the delivery of public services of mutual interest.

• Landlord shall, at Landlord’s sole cost and expense, construct and maintain the Temporary Enclosure in each Hoist Impacted Area no later than thirty (30) days following the later of (a) the actual satisfaction of the Initial Delivery Conditions thereof and (b) the expiration of Landlord’s exclusive period with respect thereto as provided in Section 13.14C hereof.

• The Hoist Impacted Area Work (as hereinafter defined) shall be Substantially Completed by Landlord, at Landlord’s sole cost and expense, no later than December 31, 2018, it being agreed that Tenant’s sole and exclusive remedy for Landlord’s failure to Substantially Complete the Hoist Impacted Area Work on or before December 31, 2018 is set forth in sub-clause (II) below.

• During the bidding process, the Developer agrees to take commercially reasonable efforts to evaluate options for and consider (i) breaking large contracts into smaller contracts; (ii) conducting outreach within the Locally Impacted Area; and (iii) reviewing bids from businesses that include minority- owned, woman-owned, and/or small or disadvantaged businesses.

• In the interests of best protecting the public safety and the efficient use of taxpayer monies, on April 12, 1994, the Parties entered into a Memorandum of Understanding Regarding Law Enforcement Duties for Areas of Madera County East of the Sierra Crest (“Original MOU”), which authorized the Mono County Sheriff’s Office and the Mammoth Lakes Police Department to provide law enforcement services in the Impacted Area.
