Additionally, Lyft will not be responsible for Delivery Claims or Support Tickets for: (i) damage or destruction to Products occurring after Delivery, or (ii) Sensitive Foods or Grocery Items that are frozen, melted, spoiled or deteriorated, or (iii) deliveries or stolen deliveries where Proof of Delivery is provided as long as Proof of Delivery aligns with the delivery address.
For the purposes of this Agreement, a “Grocery Store” shall mean a business engaged in the sale of Grocery Items (defined hereafter) and operating as a supermarket or grocery store (with or without a pharmacy) such as (by way of example and not limitation): Whole Foods, Wegmans, Trader Joe’s, Kroger, ▇▇▇▇▇▇ ▇▇▇▇▇▇, ▇▇▇▇’▇ Foods, Publix, Fresh Market, Aldi, Sprouts, Safeway, Giant and Compare Foods or similar store concepts.
Fresh Market Exclusives" means any of the following uses: grocery store, supermarket, convenience food store, or sale of Grocery Items for off premises consumption.
The foregoing shall also be deemed to prohibit the operation of pickup facilities (such as, by way of example and not limitation, those operated by a Wal-Mart and Amazon) by companies that sell Grocery Items.
The Contractor or its subcontractors who commits any of the following acts shall also be liable to the City for the costs, including attorney’s fees, of any civil action brought to recover any of those penalties or damages.
Incidental Sales" or "Incidental Use" means the sale of Grocery Items for off-premises consumption, which sales (i) are incidental to a non- grocery store primary use otherwise permitted by this Lease, (ii) do not aggregately constitute more than ten percent (10%) of such user’s total annual gross sales from such location, and (iii) are not aggregately conducted from more than the lesser of (A) five percent (5%) of such user’s floor space or (B) five hundred (500) square feet of such user’s floor space.
