Grandfathered Participant definition

Grandfathered Participant means an Inactive Participant who, on or before December 31, 1991, entered into a written agreement with the Company to terminate service to the Company or gives written notice of intention to terminate service to the Company, regardless of the actual date of termination of service.
Grandfathered Participant means a Participant who (i) is an employee of a Participating Employer on July 1, 1997, and (ii) has both attained age 50 and completed at least ten years of vesting service under the Retirement Plan on such date.
Grandfathered Participant means an eligible Employee who satisfies both of the following requirements: (i) the eligible Employee was an active participant in the Predecessor Plan as of August 1, 2008 who was accruing a Predecessor Plan benefit that is calculated under Article VI of the Funded Plan or the CNI formula set forth in Exhibit A; and (ii) the Eligible Employee was grandfathered in 1998 in his/her right to have his/her benefit under the Predecessor Plan calculated using the benefit formula set forth under Article VI of the Funded Plan or was grandfathered in 2002 in his/her right to have his/her benefit under the Predecessor Plan calculated using the benefit formula set forth in Exhibit A.

More Definitions of Grandfathered Participant
