Government Provisions definition

Government Provisions means all items belonging to the Government specified in Contract Schedule 7 and such other property (movable or immovable) which are from time to time made available to the Contractor for use in operating the Business under and in accordance with the Contract. “Government Representative” means the Director of Leisure and Cultural Services or any officer authorized to act on its behalf for the purpose of the Contract. “Gross Electricity Charge” means the total cost of electricity consumed within Ko Shan Theatre New Wing as shown and billed in the monthly bill issued by the power company. “Hong Kong” means the Hong Kong Special Administrative Region of the People’s Republic of China. “Inspection Officer” means the officer appointed by the Government for the purpose of inspecting the Business carried out by the Contractor under the Contract. “Invitation to Quotation” means the invitation issued by the Government to invite quotations to operate the Business on the terms set out in the Quotation Documents. “Intellectual Property Rights” means patents, trade marks, service marks, trade names, design rights, copyright, domain names, database rights, rights in know-how, new inventions, designs or processes and other intellectual property rights whether now known or created in future (of whatever nature and wherever arising) and in each case whether registered or unregistered and including applications for the grant of any such rights. “Ko Shan Theatre New Wing” means Ko Shan Theatre New Wing, located at 77 Ko Shan Road, Hung Hom, Kowloon, Hong Kong. “LCSD” means the Leisure and Cultural Services Department. “Licence Area” means the area as delineated in Annex C and Annex D. “Monthly Licence Fee” means the fixed monthly licence fee quoted by the successful Bidder in Contract Schedule 1. “Original Quotation Closing Date” means the date specified in the Quotation Form as the date for submission of quotation notwithstanding any extension.

  • If this AGREEMENT also concerns or references a U.S. Government contract and the AGREEMENT or Purchase Order incorporates by reference, (1) portions of the U.S. Government contract attached to the Purchase Order, and/or (2) Buyer’s Special U.S. Government Provisions, Seller agrees to comply with such U.S. Government contract requirements while also complying, to the extent permitted by law or regulation, with the above-noted order of precedence.

  • If any warranty clause is incorporated below under Clause 41, Special U.S. Government Provisions, or in the Special Provisions, such warranty provisions are in addition to the provisions in this clause to the extent to which they are consistent.

  • Orders placed under this Agreement containing a notation that the PRODUCT is intended for use under Government contracts shall be subject to the then current Government Provisions printed thereon or in attachments thereto.

  • If this AGREEMENT also concerns or references a U.S. Government contract and the AGREEMENT or Purchase Order incorporates by reference, (1) portions of the U.S. Government contract attached to the Purchase Order, and/or (2) Buyer’s Additional Standard Terms and Conditions, Special U.S. Government Provisions, Seller agrees to comply with such U.S. Government contract requirements while also complying, to the extent permitted by law or regulation, with the above-noted order of precedence.

  • These Supplemental Terms and Conditions are in addition to the United Technologies Corporation (UTC) Standard Terms and Conditions of Purchase (revision as indicated elsewhere in this order or subcontract) and the United Technologies Corporation (UTC) U.S. Government Provisions and Clauses for Orders under U.S. Government Contracts (revision as indicated elsewhere in this order or subcontract).

  • Additional Government Provisions - if a government agency has a need for rights not granted under these terms, it must negotiate with Captis to determine if there are acceptable terms for transferring such rights, and a mutually acceptable written addendum specifically conveying such rights must be included in any applicable agreement.
