Government Instrumentality means any department, division or sub-division of the Government or the State Government and includes any commission, BMC, BSCL, and other local statutory body including panchayat under the control of the Government or the State Government, as the case may be, and having jurisdiction over all or any part of the Work or the performance of all or any of the services or obligations of the Contractor under or pursuant to this Agreement;
Government Instrumentality means the GoI, the GoM and their ministries, inspectorate, departments, agencies, bodies, authorities, legislative bodies.
Government Instrumentality or “Government” means the Government of India, the Government of State and any other State, or any political subdivision, ministry, department, agency, corporation, commission or any regional, local or municipal authority or governmental body thereof or any other governmental or statutory body under the direct or indirect control of the Government of India or Government of State or of any other State, or of any political subdivision, ministry, department, agency, corporation, commission, or any regional, local or municipal authority or governmental body thereof, and shall include without limitation any other governmental or statutory body having jurisdiction over the facility or over the performance of any part of Work or the Works or any obligation of the Contractor or the Owner/Project Manager under the Contract.

Compliance with a request from the Authority or the directions of any Government Instrumentality, the effect of which is to close all or any part of the MMLP: Notwithstanding the above, the Concessionaire shall keep all unaffected parts of the MMLP open to users provided they can be operated safely.

"Operating Budget" means the budget prepared by Party B for each Operating Area estimated on the basis of RMB 2,000 per km2 on average, to be submitted to the JVC for implementation. "Operating Licenses" means all Business License, Exploration Licenses, Mining Licenses, approvals, permits and registrations that the JVC may need to operate in Contract Areas and/or Operating Areas. "Operating Procedures" means the procedures formulated by the Board of Directors for carrying out and maintaining Operating Activities. "Operating Schedule" means the schedule substantially in the form shown in Schedule "B" attached hereto and determined by the Board of Directors according to which Operating Activities are conducted and completed.
