GAF filed counterclaims seeking a declaratory judgment that the Elk patents are not infringed and are either invalid or unenforceable. GAF also asserted claims for unfair competition, Lanhxx Xxx violations based on alleged false advertising, and common law fraud, generally praying for damages of not less than $25 million including actual and punitive damages, plus interest, costs, and reasonable attorney fees.
