  • GA Plan shall be entitled to rely on statements from the participant regarding the existence and balances of loans from qualified plans and arrangements other than those of the Employer.

  • GA Plan is not responsible for preparing or filing any such informational returns.

  • If the claims, damages, losses, judgments and expenses, including but not limited to reasonable attorney fees, are the result of the negligence of both the Employer and GA Plan, the Employer and GA Plan shall be liable to the extent of degree of their respective negligence, as determined by mutual agreement of the Employer and GA Plan or, in the absence thereof, by adjudication of comparative negligence.

  • GA Plan shall assemble and provide to the Employer any tax information related to the Plan as the Employer may need to file an informational return for the Plan, or to respond to an audit request from the IRS or U.S. Department of Labor, within a reasonable time of the written request from the Employer that specifies the exact information needed.

  • GA Plan is not the administrator of the Plan, an investment manager of the Plan, or other discretionary fiduciary of the Plan.

  • The amount due and payable to GA Plan under this Agreement for services rendered up to the effective date of termination shall represent the complete and final payment, which is due.

  • To the extent that the Plan document restricts distributions, GA Plan shall review each other request for a distribution that is not a hardship distribution or distribution to a QDRO alternate payee.

  • GA Plan shall indemnify, defend and hold harmless the Employer from and against all claims, damages, losses, judgments and expenses, including but not limited to reasonable attorney fees, to the extent caused by GA Plan’s negligent performance of services under this Agreement.

  • The Employer hereby appoints GA Plan or its affiliates as its agent for purposes of accessing such information.

  • GA Plan shall treat as confidential all business information obtained or generated in the performance of services under this Agreement.

Related to GA Plan

  • Transition Plan means a transition plan, acceptable to the LHIN that indicates how the needs of the HSP’s clients will be met following the termination of this Agreement and how the transition of the clients to new service providers will be effected in a timely manner; and

  • Area plan or “multiyear area plan” means a document, developed in accordance with the uniform area plan format and IAPI issued by the department, that is submitted to the department every four years, with annual updates, by an AAA in order to receive subgrants from the department’s grants.

  • Flexi Plan means any individual indemnity hospital insurance plan under the VHIS framework with enhancement(s) to any or all of the protections or terms and benefits that the Standard Plan provides to the Policy Holder and the Insured Person, subject to certification by the Government. Such plan shall not contain terms and benefits which are less favourable than those in the Standard Plan, save for the exception as may be approved by the Government from time to time.

  • EHC plan means an Education, Health and Care plan made under sections 37(2) of the Children and Families Act 2014.

  • Company Employee Plan means any plan, program, policy, practice, contract, agreement or other arrangement providing for compensation, severance, termination pay, deferred compensation, performance awards, stock or stock-related awards, fringe benefits or other employee benefits or remuneration of any kind, whether written or unwritten or otherwise, funded or unfunded, including without limitation, each "employee benefit plan," within the meaning of Section 3(3) of ERISA which is or has been maintained, contributed to, or required to be contributed to, by the Company or any Affiliate for the benefit of any Employee, or with respect to which the Company or any Affiliate has or may have any liability or obligation;
