Funding Member definition

Funding Member has the meaning set forth in Section 3.3.

• Notwithstanding any provision in the foregoing to the contrary, if a Member fails to timely make Mandatory Capital Contribution(s) three (3) times during the term of this Agreement, the Funding Member shall have the right to buy the interest of the Non-Funding Member in accordance with the terms of Section 7.01(a)(ii).

More Definitions of Funding Member

Funding Member is defined in Section 5.1.3.

Funding Member means a Member that has committed in writing to University to share the costs of filing, prosecuting and maintaining a patent application in respect of NMSU Invention (defined below).

Funding Member means a Member that provides financing for (i) Pull-Ins pursuant to and in accordance with Section 4.3.2(c), or (ii) Financing Shortfalls pursuant to and in accordance with Section 4.3.2(d), as applicable.
