Subject to the terms and conditions contained in this Agreement, as may be modified by the provisions of Exhibit C and Sections 3.3 and 3.4 of the Funding Loan Agreement, Governmental Lender agrees to make the Borrower Loan to Borrower.
The weighted average maturity of the Funding Loan Note does not exceed 120% of the average reasonably expected economic life of the Property financed with the proceeds of the Borrower Loan.
The Funding Loan Note is not and shall not be “federally guaranteed’’ as defined in Section 149(b) of the Code.

To induce Governmental Lender to issue the Funding Loan Note, Borrower shall pay to Bank all amounts, including principal, interest and premium (if any) that become due and payable on the Funding Loan Note, as and when such amounts become due and payable under the Funding Loan Note.
