Using reasonable efforts with due diligence and good faith, and pursuant to the process in Section 5.2, Transporter and Shipper shall seek to determine the appropriate strategy, in consultation with the appropriate regulatory agencies, where appropriate, in respect of Regulatory Approvals to be obtained by or on behalf of Transporter or Shipper (in their capacities as such) to allow Transporter to provide the Services as contemplated by the FTSA Terms.
