When the Company receives cargo for carriage the Company will collect freighting costs as reported to the Minister of Land, Infrastructure and Transport and other carriage related expenses (hereinafter these expenses and costs being collectively referred to as "Freighting Costs etc.").
Freighting shall be defined as the transporting of such materials as box ▇▇▇▇▇▇, cooler trays, cans, nets, large quantities of salt or other materials which are considered as general cannery or fishing station supplies.
If cargo is ruined, substantially damaged or delivered late (in the case of late delivery as prescribed in Article 9, clause 2 only) due to a natural disaster or other unavoidable reason or due to a reason for which the Company is responsible, the Company will refund Freighting Costs etc., provided that if the Company has not already collected payment for Freighting Costs etc., the Company cannot be asked for a refund.
Notwithstanding the provisions of the preceding clause, the Company may allow collection of Freighting Costs etc.
Solutions will notify the Contractor where possible by 12.30pm, either in person when the Contractor attends the Freighting Solutions office, or by SMS, whether or not the Contractor is required the next working day.
A subcontractor shall supply a truck and body (truck) or truck, body and trailer/s (truck & trailer) which shall be suitable for cartage work to suit Freighting Solutions needs.
Any matters of dispute arising between the Subcontractor and the Contractor in connection with this Agreement shall be referred, in writing, to the Contractor within 7 days of the occurrence, for determination by Freighting Solutions and management.
The subcontractor will ensure their truck and trailer/s are washed and cleaned regularly (minimum weekly) or more regularly is the tuck is considered excessively dirty, to represent Freighting Solutions in a professional manner.
A subcontractor shall at its expense supply, install and maintain in their truck/s suitable UHF/two-way radio communication equipment required by Freighting Solutions.
For purchase of any item, service, or consulting work not covered in CONSULTANT’s approved Cost Proposal and exceeding five thousand dollars ($5,000), with prior authorization by LOCAL AGENCY’s Contract Administrator, three competitive quotations must be submitted with the request, or the absence of proposal must be adequately justified.
