Free Trial Service definition

Free Trial Service means any PROS product, service or functionality that PROS makes available to Customer to try at Customer’s option, at no additional charge, and which is clearly designated as “beta,” “trial,” “non-GA,” “pilot,” “developer preview,” “free trial,” “evaluation,” or by a similar designation.

Free Trial Service means any Okta service or functionality that Okta makes available to Customer to try at Customer’s option, at no additional charge, and which is clearly designated as “beta,” “trial,” “pre-GA,” “pilot,” “developer preview,” “free trial,” “evaluation,” or by a similar designation.

Free Trial Service means any Xecurify service or functionality that may be made available by Xecurify to Customer to try at Customer’s option, at no additional charge, and which is clearly designated as “beta,” “trial,” “non-GA,” “pilot,” “developer preview,” “non-production,” “free trial,” “evaluation,” or by a similar designation.

Examples of Free Trial Service in a sentence

• If Customer uses a Free Trial Service, PROS will make such Free Trial Service available to Customer on a trial basis, free of charge, until the earlier of (a) the end of the free trial period for which Customer agreed to use such Free Trial Service, (b) the start date of any Subscription Service purchased by Customer for the same service, or (c) termination of the Free Trial Service by PROS in its sole discretion.

• Any Customer Data and configurations entered into Customer’s Free Trial Service account may be permanently lost upon termination of the Free Trial Service.

• Except with respect to a Free Trial Service, to the extent Customer Data includes Personal Data from the European Economic Area (EEA), the United Kingdom, or Switzerland, PROS will implement the technical and organizational measures referenced in the applicable Controller to Processor Standard Contractual Clauses incorporated by reference in Customer’s Order.

• Notwithstanding anything to the contrary in Section 7 above, Customer shall be fully liable for any damages arising out of its use of a Free Trial Service.

• Notwithstanding Section 5 and 6 above, Free Trial Services are provided “as is” with no express or implied warranty and PROS shall have no indemnification obligations, nor any liability of any type with respect to a Free Trial Service, unless such exclusion of liability is unenforceable under applicable law in which case, PROS total aggregate liability arising out of or relating to a Free Trial Service is US$1,000.

Free Trial Service means any CP service or functionality that may be made available by CP to Customer to try at Customer’s option, at no additional charge, and which is clearly designated as “beta,” “trial,” “non-GA,” “pilot,” “developer preview,” “non-production,” “free trial,” “evaluation,” “early access,” or by a similar designation.

Free Trial Service means the application(s) and/or technology provided under this Agreement to You. Free Trial Service excludes Content and Non-Element Analytics Applications. “Content” means information obtained by Us from Our content licensors or publicly available sources and which may be made available to You through the Free Trial Service, as may be more fully described in the Documentation. “Documentation” means Our online user guides, documentation, and help and training materials, as updated from time to time, and which may be accessible via xxxxxxxxxxxxxxxx.xxx or by login to the applicable infrastructure(s) from which the Free Trial Service otherwise operates. Your use of the Free Trial Service shall be subject to any notice and licensing information in the Documentation as may be applicable to the infrastructure from which it operates and/or the Free Trial Service itself. “Non-Element Analytics Application” means a Web-based or offline software application that is provided by You or a third party and which may interoperate with the Free Trial

Free Trial Service means any Gryphon service or functionality that may be made available by Gryphon to Customer to try at Customer’s option, at no additional charge, and which is clearly designated as “proof of concept,” “POC,” “trial,” “pilot,” “free trial,” “evaluation,” or by a similar designation.
