FotoPunch Division means the operations of FotoPunch operating as a division of Purchaser following the Closing.
Nexus means that a partnership’s business activity is of such a degree that the state or foreign country has jurisdic- tion to impose an income tax or franchise tax measured by net income. Under Public Law 86-272, a state can’t impose an income tax or franchise tax based on net income on a partnership selling tangible personal property if the part- nership’s only activity in the state is the solicitation of or- ders, which orders are approved outside the state and are filled by delivery from a point outside the state.
Purchased Services means Services that You or Your Affiliate purchase under an Order Form, as distinguished from those provided pursuant to a free trial.
Video lottery terminal sales agent means a lottery sales agent licensed under Chapter 3770. of the ORC to conduct video lottery terminals on behalf of the state pursuant to Section 3770.21 of the ORC.

Hospice services means palliative and supportive care and other services provided by an interdisciplinary team under the direction of an identifiable hospice administration to terminally ill hospice patients and their families to meet the physical, nutritional, emotional, social, spiritual, and special needs experienced during the final stages of illness, dying, and bereavement, as defined in Minnesota Statutes, § 144A.75, subd. 8, and includes the set of services as determined by the Medicare program under §1861(dd) of the Social Security Act and defined in 42 CFR § 418.3.
Licensed Services means all functions performed by the Licensed System.
Retail Client means a client who is not a professional client;

Retail marijuana store means an entity licensed to purchase marijuana from marijuana cultivation facilities and marijuana and marijuana products from marijuana product manufacturing facilities and to sell marijuana and marijuana products to consumers.
License Key means a unique key-code that enables Licensee to run Software subject to the obtained User Pack.
Retail pharmacy means a pharmaceutical facility dispensing prescription drugs and devices to the general public.

DMAs are ranked according to the number of households therein and are used by broadcasters, advertisers, and advertising agencies to aid in evaluating television audience size and composition.
Telemedicine means the exchange of medical information from one site to another via electronic communications for the purpose of providing patient care, treatment, and services.
Retailer means every person engaged in the business of making sales at retail, or for distribution,
Wholesale drug distributor means anyone engaged in the
Game has the meaning ascribed to that term in the Control Act;
Stores means the goods specified in the Supply Order or schedule which the supplier / contractor has agreed to supply under contract.
Dark Fiber shall have the meaning set forth in Section 9.7.1.
Wholesale distributor means any person engaged in wholesale distribution of prescription drugs
Licensed service area means the geographic area in which the home service provider is authorized by law or contract to provide commercial mobile radio service to the customer.
Kiosk means a department in a RIME Store.
Wholesale Service means Telecommunication Services that Sprint provides at retail to subscribers who are not telecommunications carriers as set forth in 47 USC § 251(c)(4) which Sprint provides to resellers at a wholesale rate.
Transient merchant means any person who engages in a temporary or itinerant merchandising business and in the course of such business hires, leases or occupies any building or structure whatsoever, or who operates out of a vehicle which is parked anywhere within the City limits. Temporary association with a local merchant, dealer, trader or auctioneer, or conduct of such transient business in connection with, as a part of, or in the name of any local merchant, dealer, trader or auctioneer does not exempt any person from being considered a transient merchant.
Home health aide services means the personal care and maintenance activities provided to individuals for the purpose of promoting normal standards of health and hygiene.
Terminals means, collectively (a) the Initial Terminals; and (b) any other terminals, storage facilities, wharfage, tankage and loading racks owned or leased by any Loan Party that are used in the Business.
Producers means the agents, general agents, sub-agents, brokers, wholesale brokers, independent contractors, consultants, affinity groups, insurance solicitors, producers or other Persons who sell the Insurance Contracts.
