Settlement Payment checks shall be made out to the accountholders on the Former Customer accounts, as indicated in the Payment List.
Within seventy five (75) days following the Effective Date (hereinafter, the “Payment Date”), the Settlement Administrator shall mail checks, via first class U.S. Mail postage pre-paid, to each Former Customer account on the Payment List (including any Current Customer accounts on the Payment List for whom AT&T was not able to effectuate the corresponding account credit), drawn from the Settlement Fund Account in the Settlement Payment amounts indicated for them in the Payment List.
Notwithstanding any other provision in this Agreement, any Former Customer Class Member who files a Valid Claim shall receive at least a Cash Refund of at least $4.00.
Notwithstanding the foregoing, Former Customer agrees to remain jointly and severally liable with New Customer for any and all payment obligations assumed by New Customer hereunder.
