Form 10-D Disclosure Item definition

Form 10-D Disclosure Item means, with respect to any Person, (a) any legal proceedings pending against such Person or of which any property of such Person is then subject, or (b) any proceedings known to be contemplated by governmental authorities against such Person or of which any property of such Person would be subject, in each case that would be material to the Noteholders.

Form 10-D Disclosure Item. With respect to any Person, any material litigation or governmental proceedings pending against such Person, or against any of the Trust Fund, the Depositor, the Trustee or the Servicer, if such Person has actual knowledge thereof.

Form 10-D Disclosure Item means, with respect to any Person, any event specified in Part I of Schedule B for which such Person is the responsible party, if such Person, or in the case of either Trustee, a Responsible Officer of such Person, has actual knowledge of such event.

Form 10-D Disclosure Item means with respect to any Person, any litigation or governmental proceedings pending against (i) such Person in the case of the Issuer, the Seller, the Indenture Trustee, the Owner Trustee, the Underlying Trustee or the Servicer or (ii) a Responsible Officer of such Person in the case of the Owner Trustee, the Underlying Trustee or Indenture Trustee, to the extent such Person (or Responsible Officer of such Person, has actual knowledge thereof, in each case that would be material to the Noteholders.

Form 10-D Disclosure Item for any person means any material litigation or governmental proceedings pending against it, or against any of the Trust, the Depositor, the Indenture Trustee, the Owner Trustee, or the Master Servicer or any subservicer, if it has actual knowledge thereof.
