Firm Purchase Order definition

Firm Purchase Order has the meaning set forth in Section 2.2.3.
Firm Purchase Order shall be defined as set forth in Section 4.4.
Firm Purchase Order means, a purchase order for Products that is firm, binding, unchangeable, and non-cancelable even if delivery under said purchase order is scheduled to occur after termination of this Agreement; provided, however, that any such purchase order may be canceled by DO under any of the following circumstances: if the Products covered by the purchase order are not legally marketable or commercially available; in the event of a Default by CCSI relating to the delivery (or failure or delay in delivery) of the Products as defined in paragraph 9(a) of Section III; when there has been any other Default by CCSI under the Agreement that would give rise to a right of termination by DO; or in the event of a Force Majeure Event that prevents timely delivery of the Products covered by the Purchase Order and such delivery does not occur within six (6) months after the occurrence of the Force Majeure Event .

More Definitions of Firm Purchase Order

Firm Purchase Order means a purchase order for Products placed by GenMark, and accepted by Leica, in accordance with Section 9.4.
