FIBRA definition

FIBRA means the real estate investment trusts (for its acronym in Spanish: Fideicomiso de Inversión en Bienes Raíces) issuers of real estate trust certificates (certificados bursátiles fiduciarios inmobiliarios) referred to in Article 7 Section VII of the Single Circular, Article 187 of the LISR, and FIBRA-Related Applicable Provisions.
FIBRA. Means a Real Estate Investment Trust (Fideicomiso de Inversión en Bienes Raíces).
FIBRA means a real estate investment trust (fideicomiso de inversión en bienes raíces) established in terms of Articles 187 and 188 of the LISR (as amended, supplemented or otherwise modified from time to time). “FIBRAs Capital Gains” means any distribution received by the Trust that qualifies as a capital gain under Article 188(VII) of the LISR (as amended, supplemented or otherwise modified from time to time). “FTSE BIVA Index” means, the underlying index. “FTSE Russell” means, FTSE International Limited. “Authorized Participant Agreement” means any agreement entered into from time to time between the Trustee and an Authorized Participant, upon previous instruction of the Administrative Agent, in substantially similar terms to those set forth in the document attached to the Trust Agreement as Exhibit “B”. “Global Certificate” means the global certificate representing all the Certificates of the Issuance. “Global Fee” means the amount resulting from multiplying the Percentage of Expenses by the Net Asset Value. “Governmental Authority” means any nation, government, agency, state, municipality or other political subdivision thereof, or any other agency or entity exercising administrative, executive, legislative, judicial, monetary or regulatory functions of or pertaining to the government. “Ground Rules” has the meaning assigned to such term in Section “III. DESCRIPTION OF THE UNDERLYING INDEX - 5. Strategy and Approach” of this prospectus. “Holder” means each holder of Certificates. “Holders Meeting” means a meeting of the Holders, installed and carried out pursuant to the terms of the Trust Agreement, the Global Certificate, the LMV and the LGTOC, as applicable. “IFRS” means the International Financial Reporting Standards as issued from time to time by the International Accounting Standards Board. “Included Expenses” means the following expenses (plus value added tax), accrued each calendar month, to be paid by the Trustee in terms of Section 10.2 of the Trust Agreement: (i) expenses necessary to comply with all applicable legal provisions in order to obtain and maintain the registration of the Certificates in the RNV, their listing in BIVA and those related to the disclosure of the Prospectus, the public offering notice, the DICI or any other reports or documents that must be published at the request of the CNBV; (ii) the fees of the Trustee; (iii) the fees of the Common Representative; (iv) the fees of all third parties engaged by the Trustee (upon Instructi...
