The parties acknowledge that the Airport will be operated as a public airport, subject to the provisions of the Federal Aviation Act of 1958 and grant agreements between the City and the Federal government containing assurances guaranteeing the public use of the Airport, and consequently nothing in this Lease grants or authorizes the granting of an exclusive right within the meaning of 49 U.S.C. 40103 (e) (formerly section 308 of the Federal Aviation of 1958, as amended).
The BOCC covenants and agrees that it will operate and maintain the Airport, to the extent it is authorized to do so, as a public Airport at all times during the base term and any extension term(s) of this Lease Agreement, consistent with and pursuant to the Sponsor’s Assurances given by the BOCC to the federal government under the Federal Aviation Act of 1958, as amended.
