Failure to disclose definition

Failure to disclose means that an arbitrator must disclose even the most tangential of relationships with any arbitrating party appearing before them. Failure to disclose will result in a per se presumption of arbitrator partiality, regardless of the significance of disclosure, materiality of the disclosure to the proceedings, or length of time after the award the undisclosed information is discovered, and will vacate the award. The cost of arbitrating the issue again with an impartial arbitrator shall shift to the party with whom the previous arbitrator had an undisclosed relationship.

  • Failure to disclose these may entitle the Buyer to terminate the contract or to compensation.
