Xxxxx and Seller acknowledge and agree that the consideration for the transfer of Capacity and Capacity Attributes is contained within the relevant prices for Facility Energy.
Buyer’s Check Meters shall be for check purposes only and shall not be used for the measurement of Facility Energy, except as provided in Section 11.4(e) above.
