Schedule 2.01 (Commitments and Issuing Banks) to the Existing Loan Agreement is hereby deleted in its entirety and substituted in its stead is the updated schedule attached hereto as Annex B.
The amendments set forth herein are effective solely for the purposes set forth herein and shall be limited precisely as written, and shall not be deemed to (i) be a consent to any amendment, waiver or modification of any other term or condition of the Existing Loan Agreement or of any other Loan Document or (ii) prejudice any right or rights that the Agent and any Lender may now have or may have in the future under or in connection with the Loan Agreement or any other Loan Document.
Each reference in the Existing Loan Agreement to “this Agreement”, “herein”, “hereof” and words of like import and each reference in the other Loan Documents to the “Loan Agreement” shall mean the Amended Loan Agreement.
Except as otherwise expressly provided herein, all terms and conditions of the Existing Loan Agreement and the other Loan Documents remain in full force and effect.
This Agreement is not intended to constitute, and does not constitute, a novation of the obligations and liabilities under the Existing Loan Agreement (including the Obligations) or to evidence payment of all or any portion of such obligations and liabilities except to the extent expressly provided for herein.
