Excluded Special Servicer Mortgage Loan. Any Mortgage Loan (other than a Non-Serviced Mortgage Loan) or Serviced Whole Loan with respect to which, as of any date of determination, the Special Servicer has obtained knowledge that it is a Borrower Party.

  • To the extent that the Sub-Servicer has received written notice from the Master Servicer, that the Special Servicer is a Borrower Party with respect to an Excluded Special Servicer Mortgage Loan, the Sub-Servicer shall not provide to such Special Servicer any Excluded Information with respect to such Excluded Special Servicer Mortgage Loan.

  • If such Excluded Special Servicer Mortgage Loan is also an Excluded Mortgage Loan, the largest Controlling Class Certificateholder (by Certificate Balance) that is not an Excluded Controlling Class Holder shall appoint (and replace with or without cause) the Excluded Special Servicer for the related Excluded Special Servicer Mortgage Loan in accordance with this Agreement.

  • Joint Mortgage Loan means a Mortgage Loan originated by more than one Seller. There are no Joint Mortgage Loans related to the Trust.

  • Servicing Shift Mortgage Loan With respect to any Servicing Shift Whole Loan, a Mortgage Loan included in the Trust Fund that will be serviced under this Agreement as of the Closing Date, but the servicing of which is expected to shift to the pooling and servicing agreement entered into in connection with the securitization of the related Servicing Shift Lead Note on and after the date of such securitization. Each of the Mortgage Loans identified as “Servicing Shift” under the column entitled “Type” in the “Whole Loan” chart in the Preliminary Statement will be a Servicing Shift Mortgage Loan related to the Trust as of the Closing Date.

  • Non-Serviced Special Servicer The applicable “Special Servicer” of a Non-Serviced Whole Loan under a Non-Serviced PSA.

  • Special Serviced Mortgage Loan The Mortgage Loans for which the Special Servicer acts as servicer pursuant to Section 3.19.
