The Master Servicer shall be entitled to retain Excess Penalty Charges paid by any Mortgagor during a Collection Period with respect to any Mortgage Loan (other than the portion of such Excess Penalty Charges that relate to the period commencing after the Servicing Transfer Event in respect of a Specially Serviced Mortgage Loan, as to which the Special Servicer shall retain Excess Penalty Charges with respect to such Specially Serviced Mortgage Loan) as additional servicing compensation.
Except as provided in the last sentence of this Section 3.01(c)(25), the Primary Servicer shall not be entitled to any other additional fees, including but not limited to Excess Penalty Charges, Assumption Fees, assumption application fees, Unallocable Modification Fees, Allocable Modification Fees, Prepayment Interest Excess to the extent required by Section 6.8 of the Pooling and Servicing Agreement to offset Prepayment Interest Shortfalls on all Mortgage Loans, defeasance fees and Consent Fees.
Any Excess Penalty Charges paid in respect of a delinquent loan to which the Master Servicer is entitled under the Pooling and Servicing Agreement (other than as payment of interest on Advances or Additional Trust Fund Expenses pursuant to the Pooling and Servicing Agreement) shall be paid to the Master Servicer.
