Excepted transfer fee covenant means “a covenant to pay a private transfer fee to a covered association that is used exclusively for the direct benefit of the real property encumbered by the private transfer fee covenants.” Id. at 6708. “Covered association” means “an organization described in section 501(c)(3) . . . of the Internal Revenue Code.” Id. at 6707. Land trusts, the beneficiary of a conservation transfer fee as defined by this article, are traditionally 501(c)(3) organizations and would thus be included as a “covered association.”
Excepted transfer fee covenant means an excepted transfer fee covenant as defined in section 1228.1 of Title 12 of the Code of Regulations and permitted by section 1098.6 of the California Civil Code.
