  • In case the Software is provided via an on- premise installation or if the Software is deployed on infrastructure managed by the Customer, the Customer is solely responsible for making sure that the available updates (made available by Exalate) are installed in a correct and timely manner.

  • In case no confirmation of receipt was given by Exalate within five (5) Business Days, all notices can be done in writing and served by registered letter addressed to either Party at its address given in the Order Form or to such other address as a Party may designate by notice hereunder.

  • Exalate cannot be held liable for any damages incurred by Customer under the evaluation license.
