Exactions definition

Exactions means all development impact fees, connection or mitigation fees, taxes, assessments and other exactions required by City to support the construction of any public facilities and improvements or the provision of public services in relation to development of the Property.
Exactions means exactions that may be imposed by the City as a condition of developing the Project, including requirements for acquisition, dedication or reservation of land; and obligations to construct on-site or off-site public and private infrastructure improvements such as roadways, utilities or other improvements necessary to support the Project, whether such exactions constitute subdivision improvements, mitigation measures in connection with environmental review of the Project, or impositions made under Applicable City Regulations. For purposes of this Agreement, Exactions do not include Impact Fees.
Exactions means a requirement of development to dedicate or pay for all or a portion of land or costs of public facilities as a condition of development approval.

Examples of Exactions in a sentence

  • Except as otherwise provided herein, any and all required payments of Exactions shall be made at the time and in the amount specified by the applicable City programs or ordinances.

  • Nothing in this Agreement shall constitute a waiver of Developer’s right to challenge the legality of the amount of, allocation of, or any future increases in, the Exactions applied to the Property.

  • The Project shall only be subject to the Processing Fees and Impact Fees and Exactions as set forth in this Section 5.4, and the City shall not impose any new Processing Fees or Impact Fees and Exactions on the development of the Project or impose new conditions or requirements for the right to develop the Project (including required contributions of land, public amenities or services) except as set forth in this Agreement.

  • Development Exactions shall be applicable to development of the Property if such Development Exaction is applied uniformly to development, either throughout the COUNTY or within a defined area of benefit which includes the Property.

  • Due to Owner's payment of the Cultivation Taxes, City shall not impose any additional Marijuana Exactions on the Development, maintenance, expansion, use or operation of the Project, not specifically authorized in this Agreement.

Exactions means any requirement imposed by the City in connection with or pursuant to any land use regulation or land use approval process for the dedication of land, construction or improvement of public improvements or amenities, payment of development fees, or other mitigation measures required to mitigate the impacts of the development including, without limitation, all development impact fees or linkage fees, utility capacity fees, service or connection fees, major facilities fees, park fees, flood control fees, environmental impact mitigation fees, affordable housing fees, arts fees, transportation fees, child care fees and any similar governmental fees, charges and exactions required for the development of projects or property.
Exactions means any requirement of the City in connection with or pursuant to any Project Rule for the dedication of land, the construction of Public Improvements, or the payment of Development Fees in order to lessen, offset, mitigate or compensate for the impacts of development on the environment or other public interests, including without limitation payment of fees.
