  • Any liability under this Section will be limited to an amount in proportion to the degree to which the EWSI Party is determined to be at fault.

  • Notwithstanding any other provision of these Terms and Conditions, the settlement of any strike, lockout or other industrial disturbance shall be wholly in the discretion of EWSI and EWSI may settle such strike, lockout or industrial disturbance at such time and on such terms and conditions as it may deem appropriate.

  • When EWSI performs a repair on its Facilities affecting a Customer’s property, EWSI will make all reasonable efforts to return the property to its original or similar to original condition as soon as practicable after the repair is completed.

  • All additional services provided by EWSI to a Customer will be billed to the Customer in accordance with an agreement between the Customer and EWSI.

  • No assignment shall relieve the Customer of any of its obligations under these Terms and Conditions until such obligations have been assumed by the assignee and EWSI has agreed to the assignment and novation.

  • EWSI reserves the right to verify that all necessary authorizations have been obtained by Customers.

  • The Consultant means the person, partnership or company with whom this Contract is placed.

  • Intel means Intel Corporation, a Delaware corporation.
