Escrow Refunds definition
Escrow Refunds has the meaning set forth in the Mortgage Loan Agreement.

Escrow Refunds means amounts distributed by Lender to Borrower pursuant to Sections 3.3(c), 3.4(f), 3.5(d), 3.7(f) and/or 3.9(c) hereof.

Such deficit amount shall be promptly refunded into the Escrow Fund by any Common Equityholder who failed to make payment thereof directly to Purchaser in each such Common Equityholders' Pro Rata Share, and the Sellers' Representative shall take commercially reasonable measures to ensure the payment of such refund ("Escrow Refunds").
