ERISA Affiliate Plan definition

ERISA Affiliate Plan means each Employee Benefit Plan sponsored or maintained or required to be sponsored or maintained at any time by any ERISA Affiliate, or to which such ERISA Affiliate makes or has made, or has or has had an obligation to make, contributions at any time, or with respect to which such ERISA Affiliate has any liability or obligation.

ERISA Affiliate Plan has the meaning set forth in Section 5.03(m)(iii).

ERISA Affiliate Plan means any employee pension benefit plan (other than a Multiemployer Plan) as defined in Section 3(2) of ERISA, subject to Title IV of ERISA or Section 302 of ERISA or Section 412 of the Code maintained by an ERISA Affiliate or to which an ERISA Affiliate contributed, contributes or is obligated to contribute.

Examples of ERISA Affiliate Plan in a sentence

• Except as could not reasonably be expected to result in a Material Adverse Effect, no Borrower nor the Guarantor has any liability to an ERISA Affiliate Plan.

• Except as could not reasonably be expected to result in a Material Adverse Effect, none of the Credit Parties shall have any liability to any ERISA Affiliate Plan.

More Definitions of ERISA Affiliate Plan

ERISA Affiliate Plan shall have the meaning set forth in Section 3.12 of Annex A.

ERISA Affiliate Plan means each Employee Benefit Plan with respect to any ERISA Affiliate.
