Environmental Protection Statutes definition

Environmental Protection Statutes means each of the foregoing.
Environmental Protection Statutes means any United States local, state of federal or any foreign Law or agreement arising from or in connection with or relating to the protection or regulation of the environment (as defined in 42 U.S.C. ss.9601(8) as of the date of the Credit Agreement), including, those Laws or agreements relating to the disposal, cleanup, production, storing, refining, handling, transferring, processing or transporting of Hazardous Waste, Hazardous Substances or any pollutant or contaminant, wherever located.
Environmental Protection Statutes means all applicable laws, by-laws, regulations, standards or orders from time to time in force relating to environmental matters, the generation, use, handling, storage, disposal and transportation of any substance and the protection of the environment generally.

Examples of Environmental Protection Statutes in a sentence

  • To the best of Borrower’s knowledge, the Borrower and its Subsidiaries are in compliance with all Environmental Protection Statutes except to the extent that failure to comply does not have, and would not reasonably be expected to have, a Material Adverse Effect.

  • Comply, and cause each of its Subsidiaries to comply, with all applicable laws, rules, regulations and orders (including applicable laws, rules, regulations and orders pertaining to ERISA and applicable Environmental Protection Statutes) to the extent noncompliance therewith would have a material adverse effect on the Borrower and its Subsidiaries taken as a whole.

  • Except as set forth in Schedule 4.10 to this Agreement, Borrower and each Subsidiary has complied in all respects with all Environmental Protection Statutes, except where the lack of compliance could not reasonably be expected to materially adversely impact the business, operations, properties or condition (financial or otherwise) of Borrower and its Subsidiaries, taken as a whole, or the ability of Borrower to repay the Loan or to observe and perform its obligations under the Loan Documents.

  • To the best of Borrower’s knowledge, the Borrower and its Subsidiaries are in compliance with all, and not subject to liability under any, Environmental Protection Statutes except to the extent that failure to comply or such liability does not have, and would not reasonably be expected to have, a Material Adverse Effect.

  • The Borrower will comply in all material respects with all applicable laws (including, without limitation, all Environmental Protection Statutes), rules, regulations and orders of any Governmental Authority.

  • In performance of this order the Seller shall comply with all Federal, State and local laws, rules and regulations including, but not limited to all applicable requirements of the Fair Labor Standards Act, Equal Opportunity and Affirmative Action Statutes, and Environmental Protection Statutes and Regulations to include Executive Order 11246, as amended, 38 U.S.C. §4212, and Section 503 of the Rehabilitation Act of 1973, as amended.

  • Except as set forth in the Public Filings or as otherwise disclosed in writing by the Guarantor to the Trustee and the Agent after the date hereof and approved by the Majority Purchasers, the Guarantor and its Material Subsidiaries are in compliance in all material respects with all Environmental Protection Statutes to the extent material to their respective operations or financial condition.

  • Each of the Borrower and First Investors is in compliance with all Environmental Protection Statutes.
