Environmental Assessment Report definition

Environmental Assessment Report means for Saskatchewan, a statement as defined in section 2 of Saskatchewan’s The Environmental Assessment Act and, for Canada, the environmental impact assessment report prepared by the proponent in a cooperative environmental assessment.
Environmental Assessment Report has the meaning assigned thereto in clause (g) of the Eligible Properties definition.
Environmental Assessment Report means the written report of the person who has conducted the Environmental Site Assessment;

Environmental Assessment Report has the same meaning as “assessment report” in the EA Act;
Environmental Assessment Report the Baseline Environmental Assessment report dated January 12, 1999, relating to the Project Company, prepared by TRC Environmental Corporation; "Environmental, Health and Safety Guidelines" the IFC Environmental, Health and Safety Guidelines for Railway Systems, dated November 20, 1995, a copy of which has been delivered to, and receipt of which has been acknowledged by letter dated February 10, 2000 by, each of the Borrower and the Project Company and which is incorporated herein by reference;
Environmental Assessment Report means a report in relation to compliance with Environmental Law of the Land and any activities carried out on the Land. Environmental Law means any legislation, regulations or related codes, standards or policies which relate to environmental and planning matters, including matters concerning land use, development, building works, pollution, contamination, waste, toxic and hazardous substances, disposal of waste or other substances, human health, conservation of natural or cultural resources, heritage and resource allocation. Environmental Liability means any liability, obligation, expense, penalty or fine arising out of a breach of Environmental Law which could be imposed on any Transaction Party or the Bank in respect of the Land as a result of activities carried on during the ownership, occupation or control of the Land by that Transaction Party, the Bank, any predecessor in title or any previous occupier or controller of the Land. Event of Default means any event or circumstance described in clause 10.1. 
Environmental Assessment Report shall have the meaning assigned thereto in subsection (b) of the definition of Eligible Properties.
Environmental Assessment Report means a report in relation to the compliance of the Secured Property with Environmental Law.
Environmental Assessment Report means the report dated September 2004, prepared by the Borrower and approved by the Association, including any amendments to such report as may be agreed between the Association and the Borrower, including, inter alia: (i) the identification and assessment of the potential environmental impact of activities to be carried out under the Project; (ii) an evaluation of alternative measures; and (iii) the Environmental Management Framework, detailing the appropriate mitigation, monitoring, institutional and management measures under the Project;
Environmental Assessment Report means a written Phase I environmental hazard reports of the Land, in scope and form reasonably satisfactory to Lender, by a registered professional environmental firm selected by Borrower and consented to by Lender, such consent not to be unreasonably withheld or delayed, which shall include, at a minimum, unless otherwise agreed to by Lender in writing, an on-site inspection of the Land, a minimum of a fifty (50) year site use history from available title and business records, an investigation for underground storage tanks, a statement whether any portion of the land is in wetlands, an inventory of existing state and federal CERCLA (as hereafter defined) sites, land fills, and chemical storage ▇▇▇▇▇ in reasonable proximity to the property covered by the Deed of Trust, surface waterflow analysis for the site, and all other procedures then customary for such a Phase I environmental hazard reports, delivered by Borrower to Lender in accordance with the terms and provisions of this Agreement.
