Entryway, lobby area, hallways, elevators, stairwells, or other areas open to use by the general public.
Subject to the terms and conditions of this Agreement, and without any express or implied warranties, the City grants the Association permission to use the portion of the Right-of-Way within which the Entryway Improvements are located (the “Licensed Property”) to maintain, operate, replace, repair and remove the Entryway Improvements.
Notwithstanding any provisions in this Agreement to the contrary, the City retains the right to enter upon the Licensed Property, at any time and without notice, without obligation or duty to the Association, to remove any of the Entryway Improvements or Landscaping Improvements in the event such removal is determined to be necessary for: (a) the exercise of the City’s rights or duties with respect to the Licensed Property; (b) the protection of persons or property; or (c) the public health or safety.
The Entryway Improvements or Landscaping Improvements constitute a danger to the public which the City determines cannot be remedied by alteration or maintenance of such Entryway Improvements or Landscaping Improvements.
The Association, at its sole cost and expense, will maintain the Entryway Improvements and provide irrigation to the Landscaping Improvements.
