Encroachment Area definition

Encroachment Area means those areas within Poydras Street, Convention Center Boulevard, South Xxxxxx Street, Xxxxxx Street, Lafayette Street, Xxxxx Street and Canal Street and adjacent sidewalks and rights of ways upon which the Improvements encroach as generally described in Exhibit "A-6" attached to this Lease and made a part hereof.

Encroachment Area is defined in Section 2.2.

Examples of Encroachment Area in a sentence

• A lien will be placed on the Permittee’s property for failure to remove a revoked or abandoned Encroachment for cost incurred by CCD to remove the Encroachment and restore the Encroachment Area on behalf of the Permittee.

• The issuance of an Encroachment Permit confers no rights to the Right-of- Way, the Encroachment Permit is revocable and DOTI can order the removal of the Encroachment and restoration of the Encroachment Area for any reason the City feels relevant.

• In no event shall acceptance by Port of the Encroachment Area Charge be deemed a consent by Port to the use or occupancy of the Encroachment Area by Licensee or its Agents or Invitees, or a waiver (or be deemed as a waiver) by Port of any and all other rights and remedies of Port under this License (including Licensee's obligation to Indemnify Port as set forth in this Section), at law or in equity.

• That I am the property owner adjacent to the Encroachment Area, or the authorized representative of a Special District, that is responsible for the placement, maintenance, repair, replacement, removal, site restoration, ownership, or is otherwise responsible for the Encroachment in accordance with the Rules & Regulations for Encroachments and Encumbrances in the Public Right-of-Way.

• PG&E has inspected the Encroachment Area and has determined that the encroachments do not interfere with PG&E’s operations or PG&E’s ability to provide safe and reliable utility service to its customers.

More Definitions of Encroachment Area

Encroachment Area means that portion of the right-of-way that is subject to an encroachment permit.

Encroachment Area means that portion of the Outdoor Dining area authorized to use a portion of the City’s public right of way.
