EMPLOYEES OF THE CONTRACTOR. All work under this contract shall be performed in a professional and skillful manner. The County may require, in writing, that the Contractor, remove from this contract any employee the County deems incompetent, careless, or otherwise objectionable.

EMPLOYEES OF THE CONTRACTOR. All employees of the Contractor employed in the performance of work under the Contract shall be considered employees of the Contractor at all times, and not employees of the State. The Contractor shall comply with the Social Security Act, Xxxxxxx’x Compensation laws and Unemployment laws of the State of Arizona and all State, local and Federal legislation relevant to the Contractor’s business.

EMPLOYEES OF THE CONTRACTOR working under this contract or under a task order issued against this contract and requiring access to classified national security information and/or to areas under the control of USAID deemed "Restricted" by USAID's Office of Security must have been subject to an appropriate level background investigation by the Defense Security Service (DSS). DSS must issue either an "Interim" or "Final" security clearance for each such employee before USAID will grant him or her unescorted access to USAID's restricted spaces(s) or permit him or her access to classified national security information. If DSS issues an interim clearance but subsequently denies a final clearance for an employee of a cleared contractor, the contractor must immediately remove the employee from USAID- restricted space and prevent him or her from having access to or handling classified or administratively controlled materials. The contractor is responsible for providing properly cleared personnel to work on the contract and for ensuring that performance is not jeopardized.

In the event the Contractor wishes to substitute personnel, the Contractor must notify the County in writing and request written approval for the substitution at least ten (10) business days prior to effecting such substitution.
EMPLOYEES OF THE CONTRACTOR. 3.1 The Contractor shall provide employees who are competent in their field of specialization. The Client will have the right to have the contractor remove from the Work any person, who by misconduct or by failure to properly perform his/her duties is considered by the Client to be unfit for employment on the Work. If the contractor fails to remove any unfit person from the Work as requested by the Client, then the Client may void this Agreement or refuse to accept subsequent Work in which the person was involved and may refuse to approve payment for such Work.
EMPLOYEES OF THE CONTRACTOR. The CONTRACTOR shall be subject to and operate under all applicable Federal and State laws regarding employers’ liability, worker's compensation, Federal social security, and unemployment compensation insurance; and the CONTRACTOR expressly agrees that it is an independent CONTRACTOR and its employees engaged in the Work are not and shall not be treated or considered employees of the OWNER.
