Effective Capacity definition

Effective Capacity means the amount of capacity (in TiB) equal to the Physical Capacity multiplied by a data efficiency factor (> or = 1).
Effective Capacity in MWhr means maximum possible generation from a station during calculation period and shall be calculated as:
Effective Capacity means the lesser of (a) PMAX, and (b) maximum dependable operating capacity of the Facility to discharge Energy for eight (8) hours of continuous discharge, as measured in MW AC at the Delivery Point (i.e., measured at the Facility Meter and adjusted for Electrical Losses to the Delivery Point) as determined pursuant to the most recent Capacity Test (including the Commercial Operation Capacity Test), and as evidenced by a certificate substantially in the form attached as Exhibit I hereto, in either case (a) or (b) up to but not in excess of (i) the Guaranteed Capacity (with respect to a Commercial Operation Capacity Test) or (ii) the Installed Capacity (with respect to any other Capacity Test).

  • Column B – Will be updated over the Term of this Agreement to reflect the Capacity of the Facilities (including the Planned Uprate, but excluding Capacity related to any Uprate not accepted by Buyer pursuant to Section 2.9(a)), as determined in accordance with the MAIN Guide No. 3A Standards (or with the Effective Capacity Requirements, if applicable).

  • It is, for one Month of Operation, the difference between the Effective Capacity and the Scheduled Capacity.

  • Without prejudice to the foregoing, the Senders or Third Parties that will execute a Sole Risk Offer must assure to the Transporter that the Effective Capacity of the Pipeline will not be affected by the execution of the sole – risk proposals.

  • In the event of an Uprate, Seller will arrange for a net capability test (the "Uprate Capability Test") in accordance with ECAR 4 (or with the Effective Capacity Requirements, if applicable) to be conducted, after the Uprate is completed, tested and operational as determined by Seller, to calculate the actual net increase in the Capacity of the Facility attributable to the Uprate.

  • If the new infrastructure amends the Effective Capacity, the Transporter and the Senders or Third Parties that take part in the Sole Risk Offer will agree the terms to contract this new capacity.

Effective Capacity means the lesser of (a) PMAX, and (b) maximum dependable operating capacity of the Facility to discharge electric energy for four (4) hours of continuous discharge, as measured in MW AC at the Delivery Point pursuant to the most recent applicable Capacity Test (including the Commercial Operation Capacity Test, as evidenced by a certificate substantially in the form attached as Exhibit I hereto), in either case (a) or (b) up to but not in excess of (i) the Guaranteed Capacity (with respect to a Commercial Operation Capacity Test) or
Effective Capacity means the actual number of units utilized at the Facility from time to time.

Effective Capacity means the actual number of beds utilized at the Nursing Home from time to time.
Effective Capacity means, with respect to any Property, the number of licensed beds from time to time at the Property actually available for utilization (which may be less than the numbers of beds licensed due to utilization of single patient rooms or other reasonable and prudent operation decisions). "Emeritus" means Emeritus Corporation, a Washington corporation. "Environmental Action" means any action, suit, demand, demand letter, claim, notice of non-compliance or violation, notice of liability or potential liability, investigation, proceeding, consent order or consent agreement relating in any way to any Environmental Law, any Environmental Permit or Hazardous Material or arising from alleged injury or threat to health, safety or the environment, including, without limitation,(a) by any governmental or regulatory authority for enforcement, cleanup, removal, response, remedial or other actions or damages and (b) by any governmental or regulatory authority or third party for damages, contribution, indemnification, cost recovery, compensation or injunctive relief. "Environmental Law" means any federal, state, local or foreign statute, law, ordinance, rule, regulation, code, order, writ, judgment, injunction, decree or judicial or agency interpretation, policy or guidance relating to pollution or protection of the environment, health, safety or natural resources, including, without limitation, those relating to the use, handling, transportation, treatment, storage, disposal, release or discharge of Hazardous Materials. "Environmental Permit" means any permit, approval, identification number , license or other authorization required under any Environmental Law. 5
Effective Capacity means the actual crude oil transportation capacity of all or a segment of the Ocensa Pipeline taking into consideration any factors that would impact transportation capacity.
Effective Capacity shall have the meaning assigned to it in the Carrier’s Manual. For purposes of calculating the Contracted Capacity, the Effective Capacity shall be that determined in Annex B.
