Duties of Lea. 1. Privacy Compliance LEA shall provide data to Provider for the purposes of the Service Agreement in compliance with FERPA, COPPA, PPRA, SUPER and all other Washington privacy statutes.

LEA shall provide data for the purposes of the Service Agreement in compliance with FERPA, COPPA, PPRA, Texas Education Code Chapter 32, and all other Texas privacy statutes cited in this DPA as these laws and regulations apply to the contracted services. The LEA shall not be required to provide Data in violation of applicable laws. Operator may not require LEA or users to waive rights under applicable laws in connection with use of the Services.

The Agreement constitutes full notice of MBA’s collection, use, and disclosure practices for purposes of the Children’s Online Privacy Protection Rule (16 CFR §312.4). To the extent consent is required for such disclosed use, XXX hereby consents to MBA’s collection and processing of student personal information (see, Complying With COPPA: Frequently Asked Questions, Section N).

LEA shall take reasonable, industry standard precautions to secure usernames, passwords, and any other means of gaining access to the services and hosted Student Data. LEA is fully liable for any and all authorized or unauthorized activity occurring under credentials issued to or through LEA.
