Downstream Users definition

Downstream Users is the legal person who uses the transport infrastructure of public use to offer essential services of transport or related to this activity.
Downstream Users means those third parties owning assets, or rights to use assets, not owned by Carrier and forming part of a Segment by virtue of access and use agreements between Carrier and such third parties.

  • In order to supervise the provisions which are indicated as follows, in the event that the CONCESSIONAIRE provides two or more services in competence and in a simultaneous way, with Downstream Users, he has the obligation to keep the accounts separate.

  • The Participating State Agency must have a signed DUA on file with CMS before sharing these data with any Downstream Users.

  • The data management plan should include a list of any Downstream Users to whom the Participating State Agency anticipates making disclosures of the CMS data.

  • In any case will Final Users or Downstream Users be required to make higher payments than those resulting from applying the aforesaid Exchange Rate to Access Fees and Charges to be paid in Dollars.

  • If CMS determines that there may have been an Incident or Breach of the CMS Data or individually identifiable derivative data or information by the PMA, its contractors and/or agents, and/or any Downstream Users that violates the terms of this Agreement, CMS may, in its sole discretion, immediately and unilaterally terminate this Agreement upon notice to PMA.

Related to Downstream Users

  • Downstream means carrying a transmission from the Headend to remote points on the Cable System or to Interconnection points on the Cable System.

  • End Users means a Third Party residence or business that subscribes to Telecommunications Services provided by any of the Parties at retail. As used herein, the term “End User(s)” does not include any of the Parties to this Agreement with respect to any item or service obtained under this Agreement.

  • Downstream Affiliate means an entity whose outstanding Voting Shares were, at the date of issuance of the Qualifying Guarantee, more than 50 per cent. owned, directly or indirectly, by the Reference Entity.

  • Users means, for Services, those employees, contractors, and end users, as applicable, authorized by You or on Your behalf to use the Services in accordance with this Agreement and Your order. For Services that are specifically designed to allow Your clients, agents, customers, suppliers or other third parties to access the Services to interact with You, such third parties will be considered “Users” subject to the terms of this Agreement and Your order.

  • Digital Cross Connect System or "DCS" is a function which provides automated Cross Connection of Digital Signal Level 0 (DS0) or higher transmission bit rate digital channels within physical interface facilities. Types of DCS include but are not limited to DCS 1/0s, DCS 3/1s, and DCS 3/3s, where the nomenclature 1/0 denotes interfaces typically at the DS1 rate or greater with Cross Connection typically at the DS0 rate. This same nomenclature, at the appropriate rate substitution, extends to the other types of DCS specifically cited as 3/1 and 3/3. Types of DCS that cross connect Synchronous Transport Signal level 1 (STS-1 s) or other Synchronous Optical Network (SONET) signals (e.g., STS-3) are also DCS, although not denoted by this same type of nomenclature. DCS may provide the functionality of more than one of the aforementioned DCS types (e.g., DCS 3/3/1 which combines functionality of DCS 3/3 and DCS 3/1). For such DCS, the requirements will be, at least, the aggregation of requirements on the "component" DCS. In locations where automated Cross Connection capability does not exist, DCS will be defined as the combination of the functionality provided by a Digital Signal Cross Connect (DSX) or Light Guide Cross Connect (LGX) patch panels and D4 channel banks or other DS0 and above multiplexing equipment used to provide the function of a manual Cross Connection. Interconnection is between a DSX or LGX to a Switch, another Cross Connection, or other service platform device.
