Domestic partnership is defined by the criteria established by the Department of Human Resources for the administration of employee benefits.
If an employee chooses to complete and submit an Affidavit of Domestic partnership and sign up for medical and/or dental benefits for his or her domestic partner, the employee shall be subject to federal and state income tax withholding.
A Domestic partnership is a couple who has lived together for at least two years, are financially interdependent, are not blood relatives in a way which would bar marriage, are at least 18 years old, and are not legally married to another person.
Any employee claiming a domestic partner and/or the dependents of such domestic partner for purposes of this Article shall have an approved City Affidavit of Domestic Partnership form or a registered State of California Declaration of Domestic partnership form on file in the Employee Benefits Office, Personnel Department, which identifies that individual as the employee’s domestic partner.
Domestic partnership shall be defined as meeting all the criteria of California Family Code Section 297, et seq.
