Discrimination or retaliation means a threat, intimidation, or any adverse change in an employee's wages, benefits, or terms or conditions of employment as a result of the employee reporting a violation of this Act. In the case of a person who is not an employee of the private contractor, this term includes any adverse action taken against the person or the person's employer as a result of reporting a violation of this Act, including the cancellation of or refusal to renew a contract with the person or the person's employer.

Examples of Discrimination or retaliation in a sentence

  • Discrimination or retaliation against an employee for exercising or attempting to exercise FMLA rights.

  • Discrimination or retaliation against a patient, potential patient, concerned person, visitor, staff, or member of the public who has submitted a complaint or information to the department.

  • If the time of installation has not been agreed, the latter shall begin within two –2– weeks following written notification from the Client and shall be carried out on a continual basis until completion within reasonable time.

  • Discrimination or retaliation against an employee for alleging discrimination on any of the bases covered in this chapter is prohibited.

  • Discrimination or retaliation against an employee for opposing or complaining about any unlawful practice under the FMLA or this policy.

  • Discrimination or retaliation against employees who report in good faith alleged violations of applicable laws, rules, or regulations shall not be tolerated.

  • Discrimination or retaliation against a prospective employee for failing to disclose wage rate history is prohibited.

  • Although there is no specific time limit for reporting a suspected violation of this policy, an employee or student who believes that he or she has been subjected to conduct that violates this policy is encouraged to contact the relevant Deputy Title IX Coordinator as soon as possible after the alleged act of Sex Discrimination or retaliation to discuss the available options for proceeding.

  • Discrimination or retaliation against an individual who reports or assists in the investigation of an act of bullying is likewise prohibited.

  • Discrimination or retaliation for participation is prohibited, whether an individual volunteers or is ordered to active military service.

An employee who believes that she has been harassed, contrary to this provision shall be encouraged by both parties to follow the Employer’s policy on harassment and process. Failing resolution, an employee may follow the process set out in the Complaint, Grievance and Arbitration procedure in Article 8 of the Collective Agreement. The employee shall be encouraged by both parties to exhaust these processes prior to filing a complaint with the Ontario Human Rights Commission.

  • Discriminate means distinctions in treatment because of race, sex, color, religion, handicap, familial status or national origin of any person.

  • Harassment, intimidation, or bullying means any gesture, any written, verbal or physical act, or any electronic communication, as defined in N.J.S.A. 18A:37-14, whether it be a single incident or a series of incidents that:

  • Sexual harassment means conduct on the basis of sex that satisfies one or more of the following:

  • Personal harassment means any improper behaviour by a person employed by the Employer that is directed at and offensive to another person employed by the Employer which the first person knew or ought reasonably to have known would be unwelcome. Personal harassment comprises objectionable conduct, comment, act or display that demeans, belittles or causes personal humiliation or embarrassment to the recipient.

  • Violent felony means any offense that, if committed by an adult, would constitute a felony and:

  • Retaliatory personnel action means denial of any right guaranteed under the Act and any threat, discharge, including a constructive discharge, suspension, demotion, unfavorable reassignment, refusal to promote, disciplinary action, sanction, reduction of work hours, reporting or threatening to report the actual or suspected immigrant status of an employee or the employee’s family, or any other adverse action against an employee.

  • Discrimination on the basis of disability means any distinction, exclusion or restriction on the basis of disability which has the purpose or effect of impairing or nullifying the recognition, enjoyment or exercise, on an equal basis with others, of all human rights and fundamental freedoms in the political, economic, social, cultural, civil or any other field. It includes all forms of discrimination, including denial of reasonable accommodation;

  • Race means a group of persons related by a common descent or heredity. For purposes of enumeration the U.S. Census Bureau uses terms such as: "White/Caucasian", "Black/African American/African-descent, "Asian", "Bi-racial", "Hispanics/Latinos" etc. to describe and classify the inhabitants of the United States.

  • Whistleblower means an Employee or director making a Protected Disclosure under this Policy.

  • Violent criminal activity means any criminal activity that has as one of its elements the use, attempted use, or threatened use of physical force substantial enough to cause, or be reasonably likely to cause, serious bodily injury or property damage.

  • Retaliatory action means action which includes, but is not limited to, the refusal to continue an agreement, or a material reduction in the quality of service or quantity of products available to a wholesaler under an agreement, which refusal or reduction is not made in good faith.

  • Intentional Wrongdoing means an act or omission taken or omitted by a Party with knowledge or intent that injury or damage could reasonably be expected to result.

  • Harasses means a pattern or course of conduct directed toward another individual that includes, but is not limited to, repeated or continuing unconsented contact, that would cause a reasonable person to suffer emotional distress, and that actually causes emotional distress to the victim. Harassment shall include harassing or obscene phone calls as prohibited by Section 1172 of this title and conduct prohibited by Section 850 of this title. Harassment does not include constitutionally protected activity or conduct that serves a legitimate purpose;

  • Criminal sexual activity means the commission of an act as defined in Section 886 of Title 21 of the Oklahoma Statutes, which is the act of sodomy; and

  • Harass means to engage in a course of conduct directed at a specific person which causes substantial emotional distress to that person and serves no legitimate purpose.

  • Sex means the biological and physiological characteristics that define men and women. (MALE and FEMALE denote "sex".)

  • Religion means specific fundamental beliefs and practices generally agreed to by large numbers of the group or a body of persons adhering to a particular set of beliefs and practices.
