Discretionary Permits definition

Discretionary Permits means any permits, approvals, plans, Project Tract Maps, inspections, certificates, documents, and licenses that require a Discretionary Action, including, without limitation, site development permits, grading permits, stockpile permits, and encroachment permits.
Discretionary Permits means those Permits that are not routinely granted on application as a primarily administrative matter by the applicable Governmental Person, including specifically Interim Use Permits and Conditional Use Permits granted under Minn. Stat.§ § 462.3597 and 462.3595, respectively; provided, “Discretionary Permits” do not include road use permits, tree removal or trimming permits, water quality or stormwater runoff permits, or construction or building permits.
Discretionary Permits means any and all federal, state and local governmental permits and any governmental or regulatory approvals, other than those permits and approvals that are non-discretionary or ministerial in nature, that may be required or desirable, as determined by the Parties in their reasonable judgment, (i) to develop, implement and/or utilize the Project, (ii) to establish the Facilities, (iii) to effect any provision of or action contemplated under this Agreement, and (iv) to obtain any CEQA documentation, review and/or approvals (including, the final adjudication of any legal challenges thereto) if any is required for the improvements that will occur wholly on Cadiz’s Xxxxxx Valley Property.

Related to Discretionary Permits

  • Company Permits has the meaning set forth in Section 3.12(a).

  • Parent Permits means franchises, grants, authorizations, licenses, permits, easements, variances, exceptions, consents, concessions, registrations, clearances, exemptions, certificates, approvals and orders of any Governmental Authority necessary for Parent and each of its Subsidiaries to own, lease and operate their respective properties and assets or to carry on their respective businesses as they are now being conducted.
