Delinquent Mortgage definition

Delinquent Mortgage. Any Mortgage Loan that, as of the Transfer Date, is either (a) ninety (90) days or more past due, (b) in bankruptcy and thirty (30) days or more past due, (c) in foreclosure, or (d) in litigation, which litigation may have, in Purchaser's reasonable judgment, an adverse effect on the Mortgage Loan, the Servicing or the cost to service the Mortgage Loan. A Mortgage Loan will be considered ninety (90) days past due when, for example, the payment due on June 1, 2006 remains unpaid at the close of business on August 31, 2006.
