Defects definition

Defects means any part of the Works not completed in accordance with the Contract, or completed with deficiencies and flaws and includes deficiencies, flaws, etc. developed during the execution of Works and during the Defect Liability Period.
Defects has the meaning set forth in Section 3.20.
Defects as used in this Article shall mean any deficiency, omission, imperfection, error, flaw, shrinkage or other fault in the quality of the Works, fair wear and tear excepted.

Examples of Defects in a sentence

  • The Defects Liability Period shall be extended for as long as Defects remain to be corrected.

  • Defects of whatever kind, disappointed expectations of the buyer and/or receiving third parties do not provide any entitlement to (damage) compensation and/or settlement and/or suspension.

  • The Contractor shall supply the Employer’s Representative with a detailed final account of the total amount that the Contractor considers payable under the Contract before the end of the Defects Liability Period.

  • If after a period of thirty (30) days following delivery of goods or performance of services the State does not provide a notice of any Defects, the goods or services shall be deemed to have been accepted by the State.

  • The Employer’s Representative shall give notice to the Contractor of any defects before the end of the Defects Liability Period, which begins at Completion, and is defined in the Appendix to Form of Agreement.


More Definitions of Defects

Defects means any defect or omission in materials or workmanship and any nonconformity with the specifications for the Goods agreed in the Contract (excluding trivial or immaterial defects not affecting functionality or use).
Defects means any defect or deficiency, whether latent or patent in the design, engineering, manufacturing, workmanship or material used in any Equipment or any failure of the Equipment to comply in all respects with the Agreement including Specifications and Standards, Applicable Laws, Applicable Permits, Performance Parameters and Good Industry Practice
Defects means: (i) a failure of a configuration, modification, and/or customization of the software to operate in accordance with the Acceptance Criteria or RFP functional or technical requirements, or (ii) a failure of the Software to operate in accordance with the Software program documentation.
Defects means any deficiencies or defects in the design, construction, material and/or workmanship on the part of the Builder or its sub-contractors.
Defects has the meaning set forth in Section 4.1.
Defects means any failure(s) of the Services to substantially conform to the Specification and/or operate and function in accordance with the Specification or Service Level(s) or failure of the Contractor to provide the Services;
Defects means any defect or deficiency in supplies and/or execution of the Works or any part thereof during Project Commissioning Period and/or O&M Period, which does not conform to the specifications and standards and hampers the execution of works and/or O&M;
