If the Parties are unable to reach agreement on a final list of search terms after good faith negotiations, Tyson will, within 150 days of either (i) the Date of Preliminary Approval or (ii) the date upon which Class Plaintiffs identify custodians, whichever is later, produce non-privileged documents in its possession, custody or control that are returned by the agreed-upon Search Terms and responsive to Plaintiffs’ requests for production.
