Data Breach Protocol means the protocol to be followed on or after the Effective Date by the Plan Administrator in the event of a breach of the Personally Identifiable Information, which shall consist of delivering appropriate notice of any such breach to all affected customers in compliance with all federal and state data breach notification laws and, if applicable in the event of the termination of or a default under the License Agreement, overseeing the disposition of the Personally Identifiable Information to a subsequent licensee or purchaser or otherwise disposing of such Personally Identifiable Information as required under applicable federal and state data disposal laws.
