Customer agrees that it may not include in Customer Data or Customer Metadata, or generate any Customer Derived Data that includes, any cardholder data as defined under PCI-DSS (“Cardholder Data”) unless Customer has entered into an Order Form that explicitly permits Company to process Cardholder Data within the Services (including specifying the types and quantities of such data) and, then only with respect to the deployment(s) identified in such Order Form (the “PCI Permitted Deployments”).
In addition to use rights relating to Software, Customer shall have the right to use any Accern data feeds (to which Customer subscribes under an applicable Order) in back-testing, trading, research, and analysis, and in support of the creation of Customer Derived Data.
