Current SulphCo Shareholders means any Persons (as defined in paragraph 35) who owned SulphCo common stock as of the date of the execution of the Stipulation and who continue to hold their SulphCo common stock as of the date of the Settlement Hearing, excluding the Individual Defendants, the officers and directors of SulphCo, members of their immediate families, and their legal representatives, heirs, successors, or assigns, and any entity in which the Individual Defendants have or had a controlling interest.
