Any audit of the Subscriber’s systems will be undertaken solely for the purpose of ensuring compliance with the terms and conditions of this Agreement and such information will be held in confidence unless this information is required to be provided to a Credit Bureau, the National Credit Regulator, to satisfy any requirement in law or to the court of law.
Credit Bureau inquiries may be made (with proper authorization by the participant) in the following circumstances:• At the time of final eligibility determination• When an allegation is received by the SCHA wherein unreported income sources are disclosed.• When a participant's expenditures exceed his/her reported income, and no plausible explanation is given.
The Subscriber hereby indemnifies Accountability and/or the applicable Credit Bureau from any claims of whatever nature arising as a result of any actions taken or reliance made on information provided by Accountability and the Credit Bureau concerned.
In the event that a member terminates its membership with Accountability and such former member receives payment from a debtor whom it had listed as a default payer with any Credit Bureau, the former member retains the legal obligation in terms of Section 71A of the NCA, to update the relevant credit record.
Appendix D: Availability of Credit Bureau DataThe Reporte Crediticio de Deudores comprises the information reported monthly by banks to the regulator for each debtor.
